Programs for Students with Disabilities
 
Section 504 of the Rehabilitation Act of 1973 prohibits discrimination against persons with a disability in any program receiving federal financial assistance. It is the responsibility of the District to identify and evaluate students who within the intent of Section 504 need special services or programs in order that such student may receive the required free appropriate education.
 

A student who may need special services or programs within the intent of Section 504 is one who:

  • Has a physical or mental impairment that substantially limits one or more major life activities, including learning;
  • Has a record of such impairment or;
  • Is regarded as having such an impairment

Students may be eligible for services under Section 504 even though they do not require services pursuant to the Individuals with Disabilities in Education Act (IDEA). Students who are identified as individuals with disabilities, according to the IDEA criteria, are not addressed under this policy. The needs of such students are provided for under Massachusetts General Law Chapter 71B and its regulations and under other state and federal laws and regulations.

The Franklin Public School District does not discriminate against any person with a disability in any program or practice of the District. Each qualified person within the Franklin Public Schools who is eligible to receive special education and/or related aids or services, regardless of the nature of severity of the condition necessitating such programs or services, shall receive a free appropriate education in the District as required by state and federal law.
