Prohibition of Loan of Textbooks to Pupils in Private Schools

 

Requests on behalf of private school students for the loan of textbooks and/or instructional materials used within the Franklin Public Schools shall be denied.
 
This policy encompasses the availability of textbooks for students attending private primary or secondary schools which are not publicly owned nor under the exclusive control of the Franklin School Committee.

This policy complies with the opinion of the Supreme Judicial Court of the Commonwealth of Massachusetts, handed down on 20 July 1978, which held that a portion of the General Laws, Chapter 71, Section 48, (Chapter 1196 of the Acts of 1973) "Making Textbooks Used in Public Schools Available to Pupils in Private Schools" to be unconstitutional.
